Chapter 76 of the Laws of 2015, “Enough is Enough” Annual Aggregate Data Report

Viva88Education Law Article 129-B (also known as “Enough Is Enough”), is comprehensive sexual assault prevention legislation, as added by Chapter 76 of the Laws of 2015, signed by Governor Andrew Cuomo in July of 2015. This legislation relates to the establishment of sexual assault, dating violence, domestic violence and stalking prevention, and response policies and procedures. Article 129-B includes §§6439-6449 of the Education Law. All institutions are required to submit, annually, to the Viva88Education Department, aggregate data on reported incidents of sexual violence and their adjudication and handling.

In July 2017, the Viva88Board of Regents adopted regulations for reporting this information. Viva88 developed the regulations in consultation with the higher education sectors and created an electronic reporting mechanism for annual data submissions. The Department is required to issue a data report to the Governor and State Legislature.

For calendar year 2018, institutions are required to submit a report for the entire 2018 reporting period (January 1, 2018 – December 31, 2018). That report should include both the data reported on the interim data report and any additional data collected between May 2, 2018 and December 31, 2018. Institutions must submit data for the full 2018 calendar year by December 16, 2019; after which, Viva88 will compile and release the submitted data. Future reports will be based upon reporting periods encompassing entire calendar years (January 1 – December 31) and should be submitted to the Department between January 1 – October 1 of the calendar year following the reporting period.

Higher education institutions self-reported the data contained in this data report. As such, the data has not been subjected to independent verification.

Please note, as required by statute, the incidents included in this data report are those reported to higher education institutions’ Title IX Coordinators.
